Southern California Homeowners Face HOA Fines for Displaying American Flags Ahead of Nation's 250th Birthday

As the United States approaches its 250th anniversary, residents in an affluent Southern California neighborhood report receiving threats of financial penalties for displaying American flags outside their homes.

Homeowners in San Marcos, who reside in a townhome community managed by the Ambiance Owners Association, are steadfastly refusing to take down the American flags prominently featured on their properties, despite receiving official violation notices from the association.

Real estate listings indicate that townhomes within this particular community are valued at nearly $1 million.

The Heart of the Dispute

In May 2026, Amy and Christopher Cooke were issued a violation notice by the HOA. The notice claimed that the American flag mounted outside their residence contravened the association's flag policy and instructed them to dismantle the flag mount within 15 days, or face potential enforcement actions.

Their neighbor, Terri Collins, also received a similar violation notice regarding the American flag displayed at her home. Collins has expressed her readiness to join the Cookes in their challenge against the HOA.

Cooke emphasized the long-standing nature of the flag displays, stating,

Both American flags had been flying around here for decades without issue. The fact is it's about the American flag, distinctly.

She recounted her initial reaction to the violation notice, saying she laughed and thought,

My first reaction was, 'No.' 'Wait a minute, this isn't legal.'

For more than two decades, Cooke's flag has been flown from her garage door frame as a tribute to her husband's grandfather, who tragically lost his life in World War II while engaged in a rescue mission for fellow sailors. He was posthumously honored with both the Navy Cross and the Purple Heart.

Cooke asserts that the HOA has consistently failed to provide a clear explanation as to why it classifies her garage door frame as a common area, rather than an exclusive-use common area, under the association's governing documents.

Community Stands Firm and Seeks Support

The Cookes have dedicated nearly two years to researching federal and California statutes, compiling HOA records, corresponding with the association, and preparing for what they anticipate could evolve into a protracted legal confrontation.

To assist with potential attorney fees, court expenses, and other legal costs should the matter proceed to litigation, the couple has initiated an online fundraising campaign.

On their fundraising page, Cooke articulated their motivation:

This isn't about refusing to follow reasonable rules. We believe this is about preserving the right to display the American flag in our own community and ensuring that HOA rules are enforced fairly and consistently.

She also noted that any funds remaining after covering legal expenditures would be contributed to patriotic organizations or causes dedicated to supporting Gold Star military families.

The homeowners' struggle has garnered attention from various legal advocacy groups.

No homeowner should be threatened with fines for respectfully displaying the flag of the country they love, especially on the eve of America's 250th birthday. A blanket policy that sweeps in longstanding flag displays and punishes residents instead of pursuing reasonable solutions is likely to face serious legal scrutiny. California gubernatorial candidate Steve Hilton expressed strong disapproval in an interview with the California Post, stating,

What is wrong with these people? We are just about to celebrate the 250th birthday of our country. One of the most beautiful and magnificent things about America is the way we show our love of our country together all the time. ... And now these tin-pot bureaucrats at some ridiculous HOA want to trample on our flag and stifle national pride at this of all moments? What a bunch of anti-American losers.

Hilton encouraged residents to disregard the HOA's directives and instead respond by prominently displaying even more American flags in anticipation of the nation's 250th anniversary.

Cooke observed that the dispute has already created noticeable tension within the neighborhood.

We have flags going up and down emotionally, which is really sad,

she remarked.
