Vance Criticizes Supreme Court Birthright Citizenship Ruling, Cites "Major Mistake" and Birth Tourism Concerns

Vice President JD Vance recently expressed strong condemnation of the Supreme Court’s decision regarding birthright citizenship, labeling it "atrocious" and cautioning that it could incentivize further exploitation of the country’s immigration framework. His remarks were made during a Tuesday interview.

The Supreme Court delivered a ruling that opposed efforts by former President Donald Trump to terminate birthright citizenship, affirming that the Constitution generally guarantees automatic American citizenship to individuals born within the United States.

"This is a very disappointing ruling from the Supreme Court," Vance stated. "Of course, we respect it, but we also think that it was a major, major mistake."

Vance elaborated on his concerns, suggesting the ruling could lead to situations where individuals travel to the U.S. specifically to give birth, thereby securing "the full benefits of American citizenship" for their child and family. He characterized this outcome as "preposterous."

Judicial Decision and Administration's Stance

The Supreme Court's decision effectively nullified Executive Order 14160, which had been issued by the Trump administration. The Court determined that this executive order conflicted with the guarantee of birthright citizenship enshrined in the 14th Amendment.

This outcome ensures that most children born on American soil will continue to be granted citizenship, irrespective of their parents' immigration status—a principle that the previous Trump administration had actively opposed.

Concerns Over "Birth Tourism" and System Exploitation

Despite his disapproval, Vance identified what he termed a "silver lining" in the Court's decision. He argued that the narrow scope of the opinion implies that the concept of birthright citizenship remains precarious.

"A lot of legal experts expected this case to go the wrong direction by 7–2, or even 8–1," Vance noted, suggesting the final vote was closer than anticipated.

He further added that the ruling "effectively means that the concept of birthright citizenship, which is an absurdity to the 14th Amendment — that concept is hanging by a thread." Vance has consistently voiced his opposition to birthright citizenship, a constitutional right in the U.S. for over 150 years, contending that it rewards those who enter the country without authorization.

Path Forward and Policy Considerations

The vice president indicated that the current administration is exploring "a number" of potential strategies to address the Supreme Court’s recent decision.

Among the proposed responses are possible restrictions impacting U.S. territories, specifically mentioning the Northern Mariana Islands. These islands are situated in the western Pacific, strategically close to Asia.

Senior officials within the administration have previously raised alarms about reports of women from countries like China traveling to these islands solely for the purpose of giving birth and securing U.S. citizenship for their offspring, a practice commonly referred to as "birth tourism."

"We actually have an opportunity to reverse this decision, just as we reverse so many bad decisions throughout the generations," Vance asserted.

He concluded by emphasizing the need for comprehensive immigration reform: "We've got to fix the immigration system even more. We have to be even more aware of who's coming into our country to make sure that they're not benefiting from this atrocious Supreme Court ruling."
