Governor Maura Healey, a Democrat, was met with expressions of approval as she formally removed Massachusetts' gestational limitations on abortion, positioning the state as the tenth jurisdiction in the nation to authorize the procedure throughout pregnancy.
The newly enacted legislation, titled the Prioritizing Patient Access to Care Act, grants medical professionals expanded autonomy in deciding whether to conduct abortions later in a pregnancy. This change eliminates the legal repercussions they previously faced under earlier state regulations.
Governor Healey's Rationale and Commitment
Governor Healey articulated that the law's primary objective is to enable families confronting severe medical complications during the later stages of pregnancy to access abortion services within Massachusetts, thereby avoiding the necessity of traveling to other states. These critical situations encompass serious maternal health issues and diagnoses indicating the fetus is unlikely to survive.
During the bill-signing event, Governor Healey affirmed her commitment to upholding abortion as a safe, legal, and accessible medical option in Massachusetts throughout her tenure.
She stated, "We believe that health care decisions should be made between women and families and their doctors, not politicians." Healey further pledged, "Abortion will remain safe. It will remain legal, and it will remain accessible here in Massachusetts. That's my commitment to you."
The legislation is slated to become effective in 90 days. Prior to this new measure, Massachusetts law typically restricted abortions beyond 24 weeks of gestation, allowing only a few specific exceptions.
Governor Healey emphasized that Monday's signing represented an intention to "stand with women," contending that individuals who oppose this legislation do not adequately support women's health.
She elaborated, "The bottom line for people in Massachusetts, if you care about women's health, if you care about making sure that women are able to access the health care that they need in consultation with their doctors, should be clear." Healey concluded her remarks on the subject by asserting, "I stand with women. My opponents do not."
Healey additionally characterized the new law as a "shield" against potential national initiatives, particularly those under former President Donald Trump and Republican lawmakers, aimed at curtailing abortion protections in the aftermath of the Supreme Court's decision to overturn Roe v. Wade.
The governor asserted, "It is up to the states to lead." She further pledged, "And as governor, I promise that no matter what Donald Trump or Republicans in Congress or the Supreme Court does, we're going to continue to make sure that women and families have access to the health care that they need, right here in Massachusetts."

With this enactment, Massachusetts aligns with Alaska, Colorado, Maryland, Michigan, Minnesota, New Jersey, New Mexico, Oregon, and Vermont, as well as the District of Columbia, in eliminating gestational age restrictions on abortion.
In response to the signing, Marjorie Dannenfelser, President of SBA Pro-Life America, issued a statement Monday criticizing the "egregious" law. She argued that late-term abortions frequently involve the dismemberment of the fetus.
Dannenfelser expressed, "It should shock the conscience that tens of thousands of unborn Americans are barbarically dismembered limb by limb and torn apart every single year." She cautioned that this figure is likely to rise following Governor Healey’s endorsement of the new legislation. Dannenfelser urged the Republican Party to abandon its "leave it to the states" approach, which she believes allows for such "egregious" late-term abortion laws, and instead promote national safeguards for unborn children.

She emphasized, "Without a minimum national standard, the United States remains 1 of only 8 countries worldwide that allows abortion at any point in pregnancy. We must do all we can to turn the page on America’s ugly chapter of late-term abortion."
