The Trump administration has intervened in a contentious case involving a Texas newborn diagnosed with a severe heart condition, issuing a warning to two medical facilities that they are prohibited from denying necessary treatment on the basis of the infant's disability.

This federal involvement follows prior actions by Texas Attorney General Ken Paxton, who sought to guarantee the newborn would receive essential medical attention. The controversy originated when the biological parents reportedly requested their surrogate mother terminate the pregnancy after the baby was diagnosed with hypoplastic left heart syndrome.

McKenna West, the surrogate mother, declined this request and subsequently traveled to Texas. The infant, named Gabriel, was born on a Wednesday and immediately transferred to a neonatal intensive care unit.

In correspondence issued by the Department of Health and Human Services (HHS) civil rights office, it was explicitly stated that federal statutes forbid the denial of medical care due to an individual's disability. This prohibition extends to decisions influenced by perceptions that the life of a person with a disability holds less worth or that their existence would burden others.

HHS emphasized that these federal safeguards encompass determinations concerning life-sustaining medical interventions.

The agency confirmed it is closely monitoring Gabriel's situation and providing technical support to Children’s Medical Center of Dallas and UT Southwestern as these hospitals formulate his treatment plan.

Furthermore, HHS urged the hospitals to seek a review from an infant care committee should medical professionals contemplate withholding or discontinuing any medically indicated treatment. The department specified that life-sustaining care must be maintained throughout such a review process.

Federal Intervention and Legal Mandates

This recent federal action represents the most current intervention in the ongoing dispute surrounding Gabriel's medical care.

When McKenna West was approximately 20 weeks into her pregnancy, Gabriel received a diagnosis of hypoplastic left heart syndrome, a congenital defect characterized by a severely underdeveloped left side of the heart. According to Attorney General Paxton's office, this diagnosis reportedly led the prospective parents to request that West undergo an abortion.

Instead of complying, West traveled to Texas. Attorney General Paxton formally informed UT Southwestern Medical Center and Children’s Medical Center of Dallas of what his office asserted were their legal duties to provide Gabriel with "medically necessary, life-saving care upon birth."

Subsequently, Paxton obtained a court order specifically designed to ensure the infant would receive care following his birth.

"The court has made the right decision in immediately acting to protect baby Gabriel’s life and ensure he receives the care he deserves," Paxton stated.
"My office utilized every tool at our disposal to protect life, and we will not back down in continuing to support baby Gabriel’s well-being," he continued. "Every child in our state deserves to be cared for and protected, and that’s exactly what I’ll fight for."

Widespread Support for Surrogate Mother

The circumstances of this case have generated significant support for West from conservative and pro-life organizations, who commended her choice to proceed with the pregnancy and advocate for Gabriel's medical treatment.

Andrew Kolvet, a spokesperson for Turning Point USA, referred to West as a "hero" on social media, asserting that she "saved this baby's life" and expressing his hope that she will ultimately be able to raise Gabriel.

Alliance Defending Freedom (ADF), the legal group representing West, applauded the court order mandating that Gabriel undergo the necessary surgery. Erik Baptist, ADF Senior Counsel, commended West's "courageous stand" for Gabriel, emphasizing that "every child deserves a chance at life."

Live Action, another pro-life advocacy group, also lauded West for resisting pressure to terminate the pregnancy but noted that the battle is far from concluded. The organization voiced apprehension that a court order is currently preventing West from interacting with the newborn, stating that Gabriel "needs the comfort of the only mother he's ever known" and that his well-being should remain the paramount concern.

Gabriel's birth on Wednesday led to his immediate transfer to a neonatal intensive care unit, where medical professionals are prepared to conduct surgical procedures to address his heart condition.

"Baby Gabriel deserves a chance at life, and I will not allow anyone to unlawfully deny him medically necessary care," Paxton had previously declared. "My office will use every tool available to protect innocent lives and ensure that every child receives the care required under Texas law."
