Federal Judge Upholds '86 47' Flag as Protected Speech Amid Rising Security Concerns

A federal judge in Washington, D.C., has issued a definitive ruling affirming that an anti-Donald Trump '86 47' flag is permissible, marking a significant win for a progressive activist organization. The decision arrives amidst ongoing security concerns and incidents of vandalism near the National Mall.

The progressive group, Accountability Now USA, had flown the controversial flag in proximity to the National Mall. They contended that the National Park Service (NPS) had infringed upon their First Amendment rights by allegedly threatening to revoke their permit for the display. On Monday, U.S. District Judge Randolph Moss determined that the flag's message is indeed protected political expression.

The phrase '86 47' has been interpreted by authorities as a potential threat. The number '86' is commonly used in the restaurant industry to signify removing an item or refusing service, while '47' is understood to refer to Donald Trump as the 47th U.S. president.

"[Its] '8647' flag... is not a true threat to the President or incitement of violence," Judge Moss stated in his ruling.

In addition to the '86 47' flag, the group also displayed two other flags that accused former President Trump of sexually assaulting a minor. Judge Moss concluded that these displays are "not legally obscene" and are consequently also safeguarded by the First Amendment.

Judicial Background and Context

Judge Moss was appointed to the federal bench by former President Barack Obama. Prior to this role, he served within former President Bill Clinton’s Justice Department. He has also been noted for contributing to and volunteering for Democratic political campaigns and causes.

In an earlier order pertaining to the case, Judge Moss had acknowledged the gravity of genuine threats, stating that "a true threat to the life or safety of the President would undoubtedly outweigh the interest of the public or the speaker in continuing to urge that unlawful conduct."

The debate surrounding the nature of such messages has intensified following heightened scrutiny of '86 47' expressions. This increased attention came after large numbers, appearing to be '86 47', were etched into the turf between the Washington Monument and the World War II memorial just last month. Investigators subsequently collected grass samples from the area for analysis and examination.

The nation's capital is preparing for America’s 250th birthday celebrations, which are expected to draw massive crowds and necessitate stringent security measures, extensive road closures, and a notable increase in law enforcement presence. Donald Trump is slated to attend the "Salute to America" event on July 4th. His remarks are anticipated to begin around 9 p.m. ET, preceding what authorities have described as the largest fireworks display in history on the National Mall.

This dispute over expressive displays unfolds against a backdrop of several recent incidents involving threats and attempts on Donald Trump's life. In April, an alleged assassination attempt occurred at the White House Correspondents' Association Dinner, where an individual reportedly tried to breach the ballroom. This incident follows the approaching anniversary of a July 13th rally in Butler, Pennsylvania.

During the 2024 Butler rally, a bullet reportedly grazed Trump's ear, narrowly avoiding a fatal injury. Just two months later, another attempt on his life was reported when a man armed with a rifle was apprehended in Southern Florida. The individual was arrested after allegedly positioning a rifle through bushes near where Trump was golfing that day.

National Mall Vandalism

The National Mall itself has been the subject of particular attention this year due to a series of vandalism incidents affecting the Reflecting Pool and various monuments. This pattern of damage emerged after Trump initiated a restoration and repainting project for the Reflecting Pool, which was subsequently marred by "razor-blade cuts" to its lining, according to the White House.
